Official Rules for Yahoo! Sports Second Chance Tournament Pick'em

THE FOLLOWING PROMOTION IS INTENDED FOR PLAY IN THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY (COLLECTIVELY, THE "ELIGIBILITY AREA") AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS PROMOTION IF YOU ARE NOT LOCATED IN, AND A LEGAL RESIDENT OF, THE ELIGIBILITY AREA.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

ENTRY IN THIS PROMOTION CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

  1. Eligibility: To participate in the Yahoo! Sports "2009 Second Chance Tournament Pick'em" Promotion (the "Promotion"), you must be a legal resident of the Eligibility Area, 18 years of age or older at the time of entry, and holder of a current, valid Yahoo! ID. The Promotion is void in overseas U.S. territories, possessions, commonwealths and military installations and where prohibited by law. Employees and agents of Yahoo! Inc. ("Sponsor"), their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies, any other participating prize sponsor, and any entity involved with or otherwise providing services related to this Promotion (all of the foregoing, together with Sponsor, collectively referred to as "Promotion Entities"), and the immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win. This Promotion is subject to all applicable federal, state and local laws and regulations. To obtain a free Yahoo! ID, visit http://sports.yahoo.com, follow the "New User? Sign Up" link at the top of the page, and follow the instructions to create your Yahoo! account. You will be asked to provide your first and last name, physical mailing address (no post office boxes), telephone number, and email address. You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Promotion.

  2. How To Enter: The Promotion begins at 12:01 AM Pacific Time ("PT") on March 19, 2009, and ends at the published tip-off time of the first game of the third round of the 2009 NCAA Division 1 Men's College Basketball Tournament (the "2009 Tournament") (this period, the "Promotion Period"). To enter the Promotion, visit http://tournament.fantasysports.yahoo.com/t2 (the "Promotion Website") during the Promotion Period, create a bracket and fully complete and submit the online entry form in accordance with the instructions provided: 1) the teams you believe will win each of the final fifteen (15) games for the remaining match-ups of the 2009 Tournament (i.e., all games from Round 3 on of the 2009 Tournament) (collectively, the "Final Games"); 2) the halftime score for each team participating in the Championship Game (each, a "Halftime Score") that is currently scheduled to occur on 4/6/09 (the "Championship Game"); and 3) the final score for each team participating in the Championship Game (each, a "Final Score"). Internet access is required to enter and all entries must be submitted online through the Promotion Website. Limit five (5) entries per person and valid Yahoo! ID for the duration of the Promotion Period. Additional entries received from any one person or Yahoo! ID will be void. Each entry must be submitted separately. Incomplete entries are void. A user who has submitted the foregoing materials withinthe deadlines described in these Official Rules, and who is otherwise in full compliance with the eligibility restrictions and all other provisions of these Official Rules, is referred to as an "Entrant."

    For purposes of these Official Rules, "receipt" of an entry occurs when Sponsor's servers record your entry when properly submitted from the Promotion Website. In the event of a dispute regarding the identity of the holder of the Yahoo! ID associated with a particular entry, the dispute will be resolved in favor of the individual who is both the authorized holder of the Yahoo! ID and password associated with the account (based upon information submitted at the time the account was created or updated upon registration for this Promotion) and, if available, the "authorized email account holder" of the "alternate email address" provided when the Yahoo! ID was created. "Authorized email account holder" is defined as the natural person assigned an email address by an internet access provider, online service provider, or other organization (i.e., business, educational institution) responsible for assigning email addresses for the domain associated with the submitted email address. If there is a discrepancy between the name of the person listed as the authorized holder of the Yahoo! ID and the authorized email account holder of the alternate email address provided when the Yahoo! ID was created, that Yahoo! ID will be disqualified and any potential prize will be forfeited. A potential prize winner may be required to provide Sponsor with proof that he/she is the authorized Account holder as described above.

    The submission of an entry is solely the responsibility of the Entrant. Entries may only be made according to the method described above. Proof of sending (such as an automated computer receipt confirming delivery of email or "thanks for entering" message) does not constitute proof of actual receipt by Sponsor of an entry for purposes of these Official Rules. Sponsor is not responsible for lost, incomplete, illegible, late, damaged, delayed, garbled or misdirected entries, selections, or email messages; lost or postage-due mail; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through Yahoo.com or the Promotion Website; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any virus, error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including, but not limited to, any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Promotion; printing, typographical or other errors appearing within these Official Rules or in any Promotion-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise relating to or in connection with the Promotion, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, the processing of entries or the announcement of the prizes. Entries using a macro, bot, script, or other form of automated entry will be disqualified and are void. Entries made by anyone other than the Entrant and originating at any internet site other than the Promotion Website are void. All entries become the property of Sponsor and will not be acknowledged or returned.

  3. Grand Prize Winner Selection: The eligible Entrant that correctly identifies all of the following will be declared the Grand Prize winner (subject to verification and the terms of these Official Rules): (1) the winning team for each of the Final Games; (2) the Half-Time Score for each team participating in the Championship Game; and 3) the Final Score for each team playing in the Championship Game. In the event no Entrant correctly identifies each of the foregoing (i.e., the correct winning teams for all fifteen (15) of the Final Games as well as the Half-Time Scores and the Final Scores for each team of the Championship Game), the Grand Prize will be awarded to the Entrant who has the highest scoring bracket using Yahoo!'s default scoring method (see http://help.yahoo.com/l/us/yahoo/basketball_s/rules/scoring.html). In the event of a tie between two or more entrants, the tie will be resolved according to the following tie-breakers:

    1. to the Entrant whose answer to the Tiebreaker Question is closest to the actual total final score of the Championship Game;
    2. in the event that the tie is still not broken, to the Entrant (among those still tied) whose answer to the Tiebreaker Question is closest to the actual final score of the winning team in the Championship Game;
    3. in the event that the tie is still not broken, to the Entrant (among those still tied) whose answer to the Tiebreaker Question is closest to the actual final score of the losing team in the Championship Game;
    4. in the event that the tie is still not broken, to the Entrant whose answer to the Tiebreaker Question is closest to the actual total half-time score of the Championship Game.

    In event there is still a tie between two or more entrants after applying each of the above tie-breakers, the Grand Prize will (subject to verification) be divided evenly between all such tied entrants. All decisions of Sponsor are final in all matters, including determination of the Promotion winner, interpretation of these Official Rules, and awarding of prizes.

    PLEASE NOTE THAT EVEN IF YOUR ENTRY QUALIFIES YOU AS A POTENTIAL WINNER AT THE CLOSE OF THIS PROMOTION, YOU HAVE NOT YET WON A PRIZE. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, AND MUST MEET ALL ELIGIBILITY REQUIREMENTS BEFORE AN ENTRANT WILL BE CONFIRMED AS A WINNER AND A PRIZE WILL BE AWARDED.

  4. One (1) Grand Prize: $5,000 cash, to be awarded in the form of a check.. All costs, including federal, state and local taxes and other expenses associated with acceptance and use of the prize not specifically identified as included in the prize, are the sole responsibility of the individual winner. All prize details are at Sponsor's sole discretion. Odds of winning the Grand Prize depend on the outcome of the 2009 Tournament and the number of eligible entries received. No transfer, assignment or substitution of prize permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion of prize) of comparable or greater value, at its sole discretion. If the Grand Prize winner is an eligible minor, Sponsor reserves the right to award the Grand Prize, in Sponsor's sole discretion, to the winner's parent/legal guardian or in the name of the winner's parent/legal guardian.

  5. Winner Notification, Prize Claim and Release: The potential Grand Prize winner will be notified by email, telephone and/or mail on or about 4/09/09. The potential Grand Prize winner (and, if potential Grand Prize winner is an eligible minor, the winner's parent/legal guardian) will be required to execute and return an affidavit of eligibility, a liability release, and where permitted by law, a publicity release within ten (10) days of date of issuance of notification, together with any additional information (such as social security number or resident alien identification number) that may be required by Sponsor. Failure to satisfy any of the foregoing, comply with these Official Rules or the prize notification being returned as non-deliverable for any reason may result in disqualification. All prize claims, affidavits, and releases are subject to verification in Sponsor's sole discretion. If legitimately claimed, the Grand Prize will be awarded. No unclaimed prizes will be awarded. Each Winner will be issued an IRS Form 1099 which documents the value of the prize for tax purposes.

  6. Limitation of Liability: By entering, entrants agree: 1) that Sponsor and its designees shall have the right and permission to use entrant's name and/or picture and/or likeness or biographical information or voice for trade, advertising, promotional and/or any other purpose in any media now or hereafter known throughout the world in perpetuity without any further compensation, consideration, permission or notification except where prohibited by law; and 2) that Sponsor and its parents, subsidiaries, affiliates, directors, officers, employees, and agents (collectively, the "Released Parties") shall have no liability for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Promotion. EACH ENTRANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY THE RELEASED PARTIES, AND THEIR RESPECTIVE PARENTS, DIVISIONS, SUBSIDIARIES, AFFILIATES, ADVERTISING, PROMOTION, AND PUBLIC RELATIONS AGENCIES, AND THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS OF EACH FOR ANY LIABILITY WHATSOEVER FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, POSSESSION, USE OR MISUSE OR AWARDING OF THE PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE- OR PROMOTION-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY.

  7. General Conditions: Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Promotion, or any Yahoo! website; (b) violating these Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor reserves the right in its sole discretion to void suspect entries and/or modify, terminate, cancel or suspend this Promotion (or any portion thereof) should a virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion and, in the event of termination of the Promotion, at its discretion, select the winner from all eligible, non-suspect entries received prior to event requiring such termination using the winner determination process specified above. Any individual who submits false information, obtains entry by fraudulent means, or who is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law.

  8. Privacy: By entering this Promotion, you agree to Sponsor's use of your personal information as described in Yahoo!'s Privacy Policy, located at http://privacy.yahoo.com/privacy/us/promo/index.html.

  9. Winners Name: For the name of the Grand Prize winner (if any), available after May 16, 2009, send a stamped, self-addressed envelope no later than August 16, 2009, to: Yahoo! Sports "2009 Second Chance Tournament Pick'Em" Promotion, Winners List Requests, P.O. Box3646, Dept 18, St. Cloud, MN 56397-3646.
